The letter follows a letter dated October 22 from AT&T and Verizon to FCC Chairman Tom Wheeler by Sen. Ron Wyden (D-Ore.) and Sen. Ron Wyden (D-Oregon), which accused ISPs of throttling video and voice calls without a warrant. In the letter to Wheeler, Wyden and Wyden asked that the FCC "examine in depth the ways in which ISPs have used throttling by Verizon and T-Mobile, which are, without doubt, lawful and justified, to circumvent their contractual obligations under the Open Internet Order."
The US Justice Department has publicly expressed concern about the issues raised by the senators and their letter, saying in August that Verizon and T-Mobile were not using throttling "to circumvent contractual obligations to consumers." In the letter, Wyden and Wyden also noted that Verizon and T-Mobile were not using their own legal authority to seek to block video requests by the US Government or to provide any "reasonably reasonable justification" for their throttling practices, as mandated by the Open Internet Order.
AT&T, for its part, said in a statement issued November 21 that it does not use a court order to block video calls, but that it "does not agree with the FCC's interpretation of the Open Internet Order."
The letter also said a lawsuit filed by the groups asking the FCC to review the FCC's actions in the past year has not yet been filed.
