"This is not a federal court case," says ACLU legal director Andrew Weissman, "but rather the first step toward making clear that the court is not going to let this stand. We expect the government to make these dockets available for public review, and we want Facebook to have a full disclosure of what's going on."

While the judge acknowledged that they won't be able to get into the exact specifics, the ACLU hopes to get the court's blessing.

"To make the government so transparent about what has happened in the past is really important," says Weissman. "At this point, it's not a matter of an appeal, but an issue of how we can make it clear to the public that these are things that we think should be investigated."

The ACLU's lawsuit is asking the court to keep the information available, with a requirement that Facebook disclose "any court-ordered information or other documents related to or that may be relevant to this case."

While the court did ask Facebook to provide more details regarding the case, it didn't make any new announcements about the case.
